EVICTION NOTICE

EVICTION NOTICE ( FORCIBLE DETAINER)

A Forcible Detainer Complaint Form is a legal notice of intent to evict. You will need to go to the Fayette County District Court at 150 North Limestone or call (859) 246 - 2240 with any questions. In some cases, you will need an attorney to file the paperwork.   Have your Attorney request our office to serve your paperwork.

After your court date

If the Judge sides with the landlord, the tenant, in most cases, is given 7 days to vacate the property willingly.  The 8th day will be the first day that you can legally remove a tenant from the property.

If the tenant has appeared to move but has left property, including but not limited to couches, chairs, tables, or any other items, they are still considered to occupy the unit.

To evict a tenant, you must get a Warrant for Possession issued by a District Court Judge. This may be done over the phone at (859) -246 - 2240.  Please contact our office to schedule the eviction before calling District Court.  The Judge  will review the case and issue the Warrant for Possession  this process takes about 2 days before the Warrant for Possession issued and placed in our box for service
